These Terms of Service govern your use of hunterandnomad.com.au and any purchase you make from Hunter & Nomad.

The website is operated by Hunter and Nomad Pty Ltd ACN 644 496 024, referred to in these terms as Hunter & Nomad, we, us or our.

By accessing our website or placing an order, you agree to these Terms of Service. If you do not agree, you should not use the website or place an order.

These terms should be read together with our Privacy Policy, Shipping Policy and Returns and Refund Policy. If there is an inconsistency about shipping or returns, the relevant Shipping Policy or Returns and Refund Policy will apply.

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

1. Eligibility

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to use this website or place an order.

You must provide accurate, complete and current information when placing an order or creating an account.

If you create an account, you are responsible for keeping your login information secure and for activity conducted through your account.

2. Website use

You may use this website for lawful personal or business purposes connected with considering or purchasing our products or services.

You must not:

• Use the website for an unlawful or fraudulent purpose
• Attempt to gain unauthorised access to the website or its systems
• Introduce viruses, malicious code or other harmful material
• Interfere with the website’s security, operation or performance
• Collect website or customer data without permission
• Copy or commercially exploit our content without written permission
• Use our website or content in a way that infringes another person’s rights
• Submit false, misleading or harmful information

We may restrict access to the website where reasonably necessary to protect our business, customers or systems.

3. Product information and handmade variations

We make reasonable efforts to ensure that product descriptions, measurements, images, colours and other information are accurate.

Colours and textures may appear differently depending on your screen, lighting and device settings.

Many Hunter & Nomad products are handmade. Minor variations in colour, dimensions, shape, texture, tufting and finish are normal characteristics of handmade products and are not necessarily faults.

Measurements may vary slightly within reasonable handmade production tolerances. Any important product specific information will be included on the relevant product page.

If a product is materially different from its description or does not meet a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law.

Props, furniture and accessories shown in styled images are not included unless they are expressly identified as part of the product being sold.

4. Orders

Placing an order is an offer to purchase products from us.

An order is accepted when we send confirmation that it has been accepted or begin processing it. An automated order acknowledgement does not necessarily mean that an order has been accepted.

We may cancel or refuse an order where:

• A product is unavailable
• There is an obvious pricing or product information error
• Payment has not been authorised
• We reasonably suspect fraud or unauthorised activity
• We cannot deliver to the supplied address
• The order breaches these terms or an applicable law

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product.

5. Product availability and made to order products

Products are subject to availability.

Some products are made to order and will not be ready for immediate dispatch. Estimated production and delivery timeframes are provided on our website and in our Shipping Policy.

Production and delivery dates are estimates rather than guaranteed dates. We will contact you if we become aware of a significant delay.

If we cannot fulfil an order, we may offer an alternative product, a revised timeframe or a refund. You are not required to accept an alternative product or a materially extended timeframe.

6. Custom products

Custom products include rugs or other items produced to measurements, colours, designs or specifications selected specifically for you and which are not part of our standard product offering.

Custom products cannot be returned for change of mind because they have been made specifically for the customer.

Before approving a custom order, you are responsible for checking all measurements, colours, designs and specifications provided to us.

This does not affect your rights if a custom product is faulty, materially different from the agreed specifications or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.

7. Prices and payment

Unless otherwise stated, prices displayed on the Australian version of our website are in Australian dollars and include GST where applicable.

Shipping charges and any other applicable costs will be shown at checkout before you complete your purchase.

International customers may see prices in another currency depending on their location and website settings. Currency conversions may vary.

Payment must be made using one of the payment methods available at checkout. Available payment methods may change from time to time.

Payments are processed by Shopify and relevant third party payment providers. Their separate terms may also apply to the payment service they provide.

8. Pricing and website errors

We make reasonable efforts to ensure that prices and product information are correct. Occasionally, an error may occur.

If we identify an obvious error after you place an order, we will contact you and give you the option of proceeding with the corrected information or cancelling the affected item for a full refund.

We will not change the agreed price after accepting an order unless you agree to the change or the original price was clearly an obvious error.

9. Promotions, discount codes and Final Sale products

Temporary promotions and discount codes do not automatically make an item Final Sale.

Products purchased during a general promotion or using a discount code remain eligible for change of mind returns where they otherwise meet the requirements of our Returns and Refund Policy.

Only discontinued products, clearance products, seconds, one off pieces or other products clearly identified as Final Sale before purchase are excluded from change of mind returns.

A disclosed fault or imperfection in a second or clearance product is not grounds for a return based on that disclosed issue. This does not affect your rights in relation to another fault or any rights available under the Australian Consumer Law.

Promotional codes:

• Must be used within the stated promotional period
• Cannot be redeemed for cash
• May be subject to product or order exclusions stated with the promotion
• Cannot be applied to a completed order unless we agree otherwise
• Cannot usually be combined unless expressly stated

We may cancel a promotion or refuse the use of a discount code where there has been misuse, fraud or an obvious technical error. This will not affect an order that has already been validly accepted unless permitted by law.

10. Shipping and delivery

Our production times, shipping charges, estimated delivery times and available destinations are explained in our Shipping Policy.

You are responsible for providing an accurate and complete delivery address. Please contact us as soon as possible if you notice an error.

We cannot guarantee that an address can be changed after an order has entered production or been dispatched.

Risk in a product passes to you when the product is delivered to the delivery address provided with the order, unless otherwise required by law.

11. International orders, duties and taxes

International orders may be subject to customs duties, taxes, import charges or other fees imposed by the destination country.

Unless checkout expressly states that these charges are included, the customer is responsible for paying them.

Customs procedures may cause delays outside our reasonable control.

12. Returns, refunds and faulty products

Change of mind returns are governed by our Returns and Refund Policy.

Our change of mind policy is provided in addition to your rights under the Australian Consumer Law.

Products come with consumer guarantees that cannot be excluded. If a product has a major failure, you may be entitled to choose a refund or replacement. If a problem is minor, we may choose to provide an appropriate remedy within a reasonable time.

We may ask for photographs, an order number and other reasonable information so we can assess a reported problem. We may also ask for the product to be returned where reasonably necessary.

No time limit stated in our change of mind policy restricts your rights in relation to faulty products under the Australian Consumer Law.

13. Gift cards and store credit

Gift cards and store credit are subject to any conditions shown when they are issued.

They cannot be exchanged for cash except where required by law.

You are responsible for keeping gift card and store credit information secure. Please contact us promptly if you believe it has been used without permission.

14. Intellectual property

The website and its content, including photographs, product designs, text, graphics, logos, videos and branding, are owned by or licensed to Hunter & Nomad and are protected by intellectual property laws.

You may view the website and save or print information for personal, noncommercial use.

You must not reproduce, modify, publish, sell, distribute or commercially use our website content or product designs without our prior written permission.

Products purchased through an approved trade or wholesale arrangement are subject to the terms of that arrangement.

15. Reviews and customer content

If you submit a review, photograph or other content to us, you confirm that:

• You have the right to provide it
• It is accurate and reflects your genuine experience
• It does not infringe another person’s rights
• It is not unlawful, misleading, abusive or defamatory

We will only use customer photographs or other identifiable creative content for marketing where we have permission or another lawful basis to do so.

We may remove content from our website where we reasonably believe it breaches these terms or applicable law.

16. Third party services and links

Our website may contain links to third party websites or use services provided by third parties.

We are not responsible for the content, availability or privacy practices of third party websites that we do not control.

Using a third party service may be subject to that provider’s own terms and privacy policy.

17. Website availability

We aim to keep our website accurate, secure and available, but we do not guarantee uninterrupted or error free access.

We may update, suspend or withdraw parts of the website where reasonably necessary for maintenance, security, legal or business reasons.

To the extent permitted by law, we are not responsible for losses caused solely by events outside our reasonable control. Nothing in this section excludes rights or remedies that cannot lawfully be excluded.

18. Liability

Nothing in these terms excludes, restricts or modifies the Australian Consumer Law or any other liability that cannot lawfully be excluded.

To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when you entered into the transaction.

Any limitation of liability in these terms applies only to the extent permitted by law.

19. Events outside our reasonable control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, transport disruptions, customs delays, industrial action, government restrictions, system outages or supplier interruptions.

If such an event prevents us from fulfilling your order, we will contact you and take reasonable steps to minimise the effect of the delay. Where we cannot fulfil the order, we will provide an appropriate refund or other remedy as required by law.

20. Changes to these terms

We may update these Terms of Service from time to time.

Changes will apply from the date the updated terms are published and will not retrospectively alter the terms applying to an order that has already been accepted.

The date of the most recent update will appear at the top of this page.

21. Severability and waiver

If part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure or delay by us in exercising a right does not waive that right.

22. Governing law

These terms are governed by the laws of Queensland, Australia.

The parties submit to the nonexclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.
